Please carefully read these Terms and Conditions. If you do not agree to these Terms and Conditions then you must not access this website.

These terms and conditions apply to the use and all functionality of this website in its entirety and all contained within this website, all interaction with and through this website and all Items/Products purchases from this website.

This website is owned and operated by Woodbridge Furniture (the trading name of Pine Canection Furniture Pty Ltd ABN 65 006 189 251) located at 11-13 Bridge Street Eltham, Victoria. Australia 3095.

Terms used within;

“we”, “us”, “our”, “our store” all refer to Woodbridge Furniture at www.woodbridgefurniture.com.au

“this website” means www.woodbridgefurniture.com.au

“you”, “your”, “user”, “guest”, means anyone that visits and/or uses this website and/or purchases good from this website.

“in-store” means Woodbridge Furniture at its location 11-13 Bridge Street Eltham, Victoria 3095

“Order” means a request by you to purchase goods from Woodbridge Furniture at www.woodbridgefurniture.com.au in accordance with these Terms and Conditions

1.   User Agreement

1.1.      By your access to and use of this website, you accept these Terms and Conditions and agree to be bound by them, including all interaction and ordering of Items/Products through this website. The agreement is between you and us.

1.2.      You agree not to use any information contained within this website for commercial purposes. This would include but not limited to product duplication, image or text duplication (in any form) and price comparison and furthermore extends to the use of logos, trademarks, characteristic brand features, designs, text, icons, in their current format or any alternative variation or arrangement of them, sound or visual recordings and all software pertaining to this website.

1.3.      If you purchase Items/Products from this website and you breach any of the Terms and conditions detailed below or within, we reserve the sole right to cancel your order, either in part or full, and refund any payments made for outstanding Items/Products not already received excluding any surcharges and delivery fees for Items/Products already received.

1.4.      We reserve the right to amend these terms and conditions at any time at our sole discretion. Your continued use of this website represents an agreement by you to be bound by these terms and conditions as amended and will apply to any Order you place from the effective date of the said amendment. We recommend you review the terms and conditions for amendments each time you use this website and before placing any Order. You agree to receive email notification from us that we may send of any amendments to these terms and conditions.

2.   User Account & Legal Capacity                                                    

2.1.      In order to purchase any Items/Products using this website, you must be eighteen (18) years of age or older and:

a)      any order you place is your acknowledgement that you are eighteen (18) of age or older and you accept these terms and conditions and agree that you have entered into a legal contract with us in relation to these terms and conditions and on purchasing any Items/Products, a legal sales contract  with us;

b)      you must either create a new user account (“Account”) or make your purchases as a guest (“Guest”).  In order to purchase Items/Products using this website you will need to provide certain information such as your name, delivery address, billing address, phone number / mobile (cell) number and email address. You also agree that for any delivery purposes (if applicable), we may pass this information to a third party to facilitate delivery of your Items/Products purchased;

c)      we reserve the right to verify the information that you provide before accepting a new Account and any associated purchases, or accepting a purchase by a Guest;

d)      by using this website, you are completely responsible for maintaining the confidentiality of your Account and Password and for limiting access to your computer to reduce the risk of security breach, and you agree to accept responsibility for all activities that occur under your Account or Password. If you believe your Account’s security has been compromised in any way, you agree to notify us immediately by email and telephone;

e)      we reserve the right to take legal action and seek compensation for any loss or damage we may incur as a result of any transaction/s entered into by a minor, from the parent/s or guardian of a minor who causes an Order to be placed.

3.   Purchases & Orders for Items/Products

3.1.      We only sell Items/Products within Australia and can only ship to locations where we can provide a delivery service.  We do not Deliver/Freight Items/Products outside of Australia at this time.

3.2.      You may purchase or order Items/Products online by utilizing the shopping cart and submitting your order through this website’s checkout in accordance with these terms and conditions.

3.3.      Please choose carefully as refunds are not normally provided where you have simply changed your mind, made an incorrect selection, found the Item/Product cheaper elsewhere or had a defect drawn to your attention before buying (such as goods labelled as seconds with their faults clearly marked). We highly recommend you meticulously preview any Items/Products you intend to Order before adding them to your shopping cart and proceeding with your Order.

3.4.      Any order placed through this website for a Product is an offer by you to purchase the particular Item/Product for the price displayed (including the delivery, surcharges, other charges and taxes) at the time you place the order.

3.5.      If deemed necessary, we may ask you to provide additional details or require you to confirm your details to enable us to process any orders placed through this website.

3.6.      You agree to provide us with current, complete and accurate details at all times on this website or by our request and agree to update them as necessary to ensure they remain current at all times throughout the sale process.

3.7.      You acknowledge that the transmission of your order or payment via electronic means may not be received by us for reasons beyond our control including but not limited to failures of power, software, telecommunications, servers, computers, networks, internet providers, hosts and any associated equipment including databases and hosting platforms.

4.   Order Acceptance

4.1.      When you place a purchase order with us, we will notify you that your order has been received by sending you an “Order Confirmation” at the time that your order is placed however, your order will not be processed until we confirm that full payment has been cleared and received by us.  We will formally accept your order only when it has passed our internal validation process for verifying the authenticity of each order placed, for the purpose of preventing credit card or payment fraud and any other fraudulent activity.

4.2.      Confirmation that your order has been accepted and re-confirmation of delivery charge/s will be by telephone and/or email and generally within 1-3 business days of receiving your order.

4.3.      Woodbridge Furniture, at our sole discretion, absolutely reserves the right to refuse service, remove or edit any/all content, reject or cancel orders and terminate Accounts.

4.4.      If we cannot process or accept your order after payment is received we will contact you by email or telephone and arrange to refund your payment or if you prefer, raise a credit that can be used to purchase Items/Products in the near future and within 12 months from the original purchase order date.

4.5.      It is entirely your responsibility to ensure all contact details you provide, when creating an Account or as a Guest, are correct to ensure we can contact you if and when necessary and we in no way will be held responsible for these details being incorrect.

4.6.      Please ensure you provide the relevant means to elevate emails we may send you being filtered as junk mail or spam. This may be achieved by either saving our email address in your contacts folder or marking our email address as safe within internet security programs or other relevant security software.

5.   Payment Methods Accepted

5.1.      Woodbridge Furniture currently accepts Visa, MasterCard, American Express, Diners Club and PayPal only. (Note: Surcharge currently applies to payments made by American Express (1.9%) and Diners (2.9%)

5.2.      Payments are processed via secure payment gateway facilities accessible via this website and will be subject to any terms and conditions of these providers.

5.3.      Credit card and PayPal payments are processed on completion of the Check Out process.

5.4.      If you choose to pay by credit card or PayPal, you authorise us to charge all fees incurred for an accepted order to PayPal or the credit card nominated by you. If we are unable to successfully process your credit card or PayPal payment or if payment is not received from PayPal or the card issuer for any reason, you agree to pay us all amounts due on demand or our sole discretion we may cancel your order and advise you of the same.

5.5.      We reserve the right and at our sole discretion to validate credit card information supplied or received, through any means we deem necessary, to elevate potential fraudulent activities.

5.6.      You must not pay, or attempt to pay, in any manner whatsoever for Items/Products through any fraudulent or unlawful means. Any fraudulent activities detected will be passed on to the most appropriate law enforcement authorities.

5.7.      On placement and/or completion of your order, you will receive your Tax Invoice. This may be provided by hard copy or electronic format (email). This Tax Invoice will be considered proof of purchase only when payment has been received in full and your have provided your signature as receipt of your order at the time of delivery or collection.

6.   Prices

6.1.      The prices of Items/Products displayed on this website are inclusive of GST and do not include freight or delivery charges. Unless otherwise stated, Items/Products displayed on this website do not include accessories of any kind.

6.2.      Woodbridge Furniture reserves the right at any time and without notice, to change the price of Items/Products on our website. The prices displayed on our website are only applicable to this website and may or may not be available in-store.

6.3.      Woodbridge Furniture reserves the right at any time whatsoever to correct or update errors of any kind pertaining to any Items/Products displayed on this website.

6.4.      The Delivery charge applied to an order is only applicable to that order and is only payment for one delivery. If multiple deliveries are required, whether they are the same type or different transport methods, you must create a separate order for Items/Products required for each separate delivery (charged accordingly) or contact us directly to discuss possible options.

6.5.      The Delivery charge and choices thereof provided for the Items/Products within the shopping cart is indicative and may need to be revised (recalculated) to respond to some factors not taken into account such as:

a)      Item/Product – Type, Size, Quantity

b)      Delivery Location

c)      Delivery Access

d)      Multiple Deliveries Requested

e)      Additional Person/s Required

f)       Different Transport Methods

If this eventuates, you will be contacted and advised of any potential delivery charge variations prior to processing your order. If you accept the variations then we will continue to process your order. If you do not accept the variations then you may choose to collect your order from our store, in which case we will refund the delivery charge OR you may choose to cancel the order, in which case we will refund your payment or if you prefer, raise a credit that can be used to purchase Items/Products in the near future and within 12 months from the original purchase order date.

7.   Fees and charges

7.1.      We will charge you, and you agree to pay, the purchase price of each Product that is ordered, the delivery fee for your order that we notify to you when you place your order (if applicable) and any other fees, and charges set out in these terms and conditions.

7.2.      All fees and charges identified in these terms and conditions and all prices for the Items/Products on this website are inclusive of GST where applicable, and are in Australian dollars. You may choose to view prices in different currencies by selecting from the relevant currency options provided.

7.3.      The purchase price of each Item/Product is shown on this website when you place your order are applicable only to this website. The purchase price of Items/Products on this website may or may not differ from in-store.

7.4.      Prices for Items/Products on this website may change from time to time and we do not provide any notice whatsoever of these changes. Subject to these terms and conditions, once we accept your order, we will not change any prices that apply to the Items/Products ordered.

7.5.      If you decide to cancel you order/s then any refund will be in accordance with the terms of our Refund Policy.

8.   Deliveries / Freight / Transport

8.1.      Woodbridge Furniture can only ship to a location where we can provide or arrange a delivery service.  We do not Deliver/Freight Items/Products outside of Australia at this time.

8.2.      All delivery / freight costs are extra (charged separately) to any Items/Products prices displayed on this website (ie; Delivery / Freight charge is NOT included in any item prices). Therefore unless freight has been charged and shown on your purchase order or invoice, it is considered a “Pick-Up” Item/Product. We will contact you when processing your order and advise you when your purchase will be ready for delivery or available for collection from our store.

8.3.      Acceptable methods of Delivery / Freight services that we provide are dependent on the type, size and quantity of Items/Products purchased. They are:

a)      Australia Post (Giftware/Homewares)

b)      Courier/Express Road Transport (Giftware/Homewares/Small - Medium Furniture Items)

c)      Furniture Carrier (Furniture/Giftware/Homewares)

8.4.      We will nominate the most appropriate Delivery / Freight service/s for the Items/Products being transported to ensure your purchase arrives in a timely manner. This will be indicated in the shopping cart and/or checkout area of this website. Only if we deem you have chosen an inappropriate method of transport for the type, size and/or quantity of Items/Products purchased (either through your possible entry error or this website not providing the correct choice for the items or quantity of Items/Products purchased), we will contact you prior to processing your order and recommend the most appropriate transport method and advise you of any additional charge this may incur. If you accept the alternate recommended transport method and there is an additional charge involved, then you agree to pay any difference before we continue the processing of your order. If you do not accept the recommended transport method and there is an additional charge involved then you may choose to collect or arrange collection of your order from our store, in which case we will refund the delivery charge OR you may choose to cancel the order, in which case we will refund your payment or, if you prefer, raise a credit that can be used to purchase Items/Products in the near future and within 12 months from the original purchase order date.

8.5.      At our complete discretion after processing your order, we reserve the right to alter the selected carrier service without any further costs to you. This decision may be without notice and will generally be made to keep shipping timelines to a minimum and/or to ensure the most appropriate mode of transport is implemented.

8.6.      Giftware & Homeware Items – will generally be sent or transported by Australia Post or Courier

8.7.      Furniture items – will generally be sent or transported by a Furniture Carrier. Courier may be utilized if we deem appropriate for the item/s purchased.

8.8.      Melbourne Metro Deliveries

a)      Our store based in Eltham, a suburb of Melbourne Victoria. We have contracted Couriers, Express Road Transport Companies (ERT) and reputable Furniture Carriers to transport our Items/Products direct to your door.

8.9.      Victoria Country Regional/Rural Area Deliveries

a)      Deliveries to Country/Regional/Rural areas will be transported by Courier/Express Road Transport (if deemed appropriate by us) or Independent Furniture Carriers and will be charged according to your location and the amount of furniture Items/Products ordered. This charge will be indicated in the shopping cart and/or checkout area of this website. If the option for delivery to your area is not available in the shopping cart and/or checkout area of this website, you can request a freight quotation to your location prior to placing the order OR by choosing ‘Pick-up’ when placing your order and requesting a freight quotation to your location within the ‘Add Comments About Your Order’ area provided, when finalising your order. Prior to processing your order, we will contact you and advise you of the freight options available & delivery charge and/or any extra charges that may be incurred in transporting Items/Products to your location. If you accept the freight option provided and the additional charge involved, then you agree to pay all associated charges before we continue the processing of your order. If you do not accept the freight option provided and the additional charge involved then you may choose to collect or arrange collection of your order from our store OR you may choose to cancel the order, in which case we will refund your payment or, if you prefer, raise a credit that can be used to purchase Items/Products in the near future and within 12 months from the original purchase order date.

8.10.   Interstate Deliveries

a)      Deliveries interstate (outside of Victoria) will be transported by Courier (if deemed appropriate by us) or Independent Furniture Carriers and will be charged according to your location and the amount of furniture Items/Products ordered. This charge will be indicated in the shopping cart and/or checkout area of this website. If the option for Interstate delivery to your area is not available in the shopping cart and/or checkout area of this website, you can request a freight quotation to your location prior to placing the order OR by choosing ‘Pick-up’ when placing your order and requesting a freight quotation to your location within the ‘Add Comments About Your Order’ area provided, when finalising your order. Prior to processing your order, we will contact you and advise you of the freight options available & delivery charge and/or any extra charges that may be incurred in transporting Items/Products to your location. If you accept the freight option provided and the additional charge involved, then you agree to pay all associated charges before we continue the processing of your order. If you do not accept the freight option provided and the additional charge involved then you may choose to collect or arrange collection of your order from our store OR you may choose to cancel the order, in which case we will refund your payment or, if you prefer, raise a credit that can be used to purchase Items/Products in the near future and within 12 months from the original purchase order date.

9.   Delivery of Items/Products

9.1.      You agree to abide by all delivery requirements as specified below and any other requirements that we may notify you of when you place any order through this website.

9.2.      Delivery times quoted either on this website or by our staff for orders placed by you are approximate only and are based on quoted delivery information from our manufacturers or importers excluding public holidays. You will be notified were possible of any undue delays if or when they arise.

9.3.      Via Australia Post – Items/Products that are shipped by Australia Post will be dispatched as soon as they become available. You must sign to acknowledge receipt of your order and that all Items/Products received are correct and in good order and condition.

9.4.      Via Courier Including Express Road Transport - Items/Products that are shipped by Courier/Express Road Transport will be dispatched as soon as they become available. We will advise you by phone and/or email either when the order has been dispatched or due to be dispatched so you can expect delivery. Where possible we will provide an Estimated Time of Arrival (ETA) and tracking information. Once your order has been dispatched you or your authorised representative must be available to accept delivery. With the exception of any tracking information provided to you, it is generally not possible to provide any advanced warning of the Courier’s (Express Road Transport) pending arrival including requests for specific delivery days and/or times, or to ring you prior to delivery. This possibility only exists from limited Couriers/Express Road transport companies and comes at additional costs that can vary somewhat depending on the request. Therefore if you have no other choice and require this type of service, then you must contact us or provide this request when placing your order. We will then advise you of the additional cost associated with your request (if available) prior to processing your order. Any requests received after dispatch of your order will not be possible. You must sign to acknowledge receipt of your order and that all Items/Products received are correct and in good order and condition.

9.5.      Via Furniture Carrier – Items/Products that are shipped by Furniture Carriers will be dispatched as they become available and following confirmation with you of an arranged delivery date and time. Any times quoted are estimates only without guarantee due to various factors that may impede transport. We or the chosen carrier will advise you by phone and/or email if there are any undue delays. You must sign to acknowledge receipt of your order and that all Items/Products received are correct and in good order and condition.

9.6.      All Items/Products ordered and or delivered to you remain the property of Woodbridge Furniture until full payment (including freight or any other applicable charges) have been verified as received by us and you (the authorised person) have signed to acknowledge receipt of your order and that all Items/Products received are correct and in good order and condition.

9.7.      Whilst every effort is made to deliver your order according to the estimated delivery day and times arranged or provided, unforeseen circumstances beyond our control may affect delivery times. When we become aware of any unexpected delivery or scheduling problems that may affect your delivery, we will endeavour to apprise you of the situation as soon as possible.

9.8.      We or the delivery company may need to contact you via telephone to arrange a delivery date and timeframe for certain Items/Products. Please ensure all contact details provided to us at the time of placing an order are kept current.

9.9.      You may choose to collect (Pick-Up) your order directly from Woodbridge Furniture.  If this option is available in your shopping cart or at checkout and you select it, then any delivery fee will be adjusted or removed accordingly.

9.10.   Pick-up of Items/Products may only occur once all relevant Items/Products have been paid for in full and clear funds have been verified as received by us.  Do not attempt to pick up any Items/Products or part thereof until you have spoken directly with us to confirm that the relevant Items/Products are available for pick-up and that payment for the relevant Items/Products has been verified as received by us.

9.11.   You are entirely responsible to ensure that:

a)      Items/Products ordered are suitable and the correct size for the space intended within your home or establishment.

b)      If you have chosen delivery, to ensure that such Items/Products are of a size and weight that can be handled safely and effectively by the carrier whilst effecting the delivery, and will fit through relevant doorways, internal passages, stairs, landings, pathways etc. to the intended final location.

9.12.   We will not be held responsible whatsoever if the Items/Products have been ordered incorrectly and/or do not fit, or cannot be delivered to the intended final location for reasons detailed above. If this happens then you must sign for the said Items/Products as proof of accepting delivery without question and direct the carrier to leave the Items/Products in an alternative location within the property or establishment of the intended final delivery location. At our absolute discretion we may consider returning the Items/Products that have either been ordered incorrectly or do not fit. If we agree to this action then you will be responsible for any/all costs involved in returning the Items/Products (ie: freight charges) to our store including a restocking fee. If we take this action we agree to either exchange, refund or provide a store credit at our absolute discretion for any or all Items/Products returned, excluding any freight or restocking fees.

9.13.   The Delivery fee charged excludes assembly of any Item/Product purchased. If you require assembly of your furniture an additional charge will apply with the amount dependant on the requirements of the assembly. You must notify us either at the time of purchase, or when we contact you to arrange delivery … either way, this must be prior to Items/Products being dispatched. At this time we will advise you of the additional charge payable. This additional charge must be paid prior to delivery or if agreed to by us, payable to the person/s performing the assembly.

9.14.   We request that you or a person authorised by you be present to accept the delivery of your order if you have paid by credit card.

9.15.   We may require you or the authorised person accepting the delivery of your order to provide us with acceptable proof of identity that may include a photograph ie; Drivers license, Passport.

9.16.   If the order has been paid by credit card, then we may ask you to show us the credit card for us to conduct verification checks.

9.17.   If you are required to be present at the arranged date and time frame of delivery and you or an authorised person are not present at that time, then we will not deliver your order. In this instance, we will endeavour to contact you to organize to deliver your order at a newly arranged time frame and will charge you an additional delivery fee as this would be considered an extra delivery.

9.18.    Where orders are shipped by Courier/Express Road Transport, you agree that it is your responsibility to make yourself available to accept delivery of your order. Where possible we will provide an Estimated Time of Arrival (ETA) and tracking information. Once your order has been dispatched you or your authorised representative must be available to accept delivery. With the exception of any tracking information provided to you, it is generally not possible to provide any advanced warning of the Courier’s (Express Road Transport) pending arrival including requests for specific delivery days and/or times, or to ring you prior to delivery. If you or your authorised representative is not available, no matter the reason, to accept delivery of your order then your order will be returned to the nearest depot to await re-delivery. Re-delivery charge/s (if any) may apply which you agree to pay. If after attempts to re-deliver or arrange re-delivery of your order fail, we may instruct the Courier/Express Road Transport Company to return the goods to us. You will be liable for all associated freight costs.

9.19.   You agree without reservation that any person at the delivery address who receives the Product is authorised by you to receive your order and will provide us with proof of identification to conduct verification checks (detailed previously).

9.20.   You must provide clear passage and access for the delivery of your order. You agree to notify us if the passage or access is difficult at the time of arranging delivery or at the latest, prior to your order being dispatched. Difficult access may result in additional delivery fee to cover costs related to extra time or person/s required.

9.21.   Delivery personnel will at all times be careful and diligent, however we will not be held responsible for any accidental damage of any kind to your property that may occur during the delivery process.

9.22.   Delivery time frame is approximate only and quoted in good faith, however we will not be held responsible for unforeseen delays.

9.23.   Unless prior arrangements have been made, you will accept delivery of your order at your earliest convenience and no later than 21 days of being notified that your order is ready for dispatch. If for any reason this is not possible we may be able to arrange storage of your Items/Products. This may result in storage charges of which you will be advised if required.

10.       Cancelling an Order

10.1.   We may cancel any order either in part or full, including any orders that we have accepted, without any liability to you whatsoever for the said cancellation at any time if any of the following occurs:

a)      Some or all of the Items/Products in the order received are not available

b)      Error/s in the price or the Item/Product description detailed on this website for any Item/Product ordered

c)      That we reasonably believe or become aware that your order has been placed in breach of these terms and conditions

10.2.   If we cancel your order we will not charge you for your order and will endeavour to provide you with notice of the cancellation and in a reasonable timeframe.

10.3.   Any cancelation of orders, refunds, store credits, exchanges or return of any Item/Product by a customer will be carried out in accordance with the terms detailed in our Refund Policy.

11.       Damaged or Faulty Items/Products & Refund Policy

11.1.   If any Item/Product ordered by you arrives damaged or is not of acceptable quality you may have:

a)      rights under the Refund Policy;

b)      legal rights and remedies in Australia under the Competition and Consumer Act 2010 and other rights under other consumer laws applying in each Australian State and Territory.

c)      the right to have the product repaired or replaced or to receive a refund of the price paid by you for the item/product.

11.2.   When purchasing, please choose carefully as refunds are not normally provided where you have simply changed your mind, made an incorrect selection, found the Item/Product cheaper elsewhere or had a defect drawn to your attention before buying (such as goods labelled as seconds with their faults clearly marked). 11.3.   If your order arrives damaged, please contact our store immediately and we will advise you of the appropriate course of action to rectify the problem.

13.       Disclaimer and Indemnity

13.1.   To the extent permitted by law Woodbridge Furniture exclude any and all liability to you or anyone else for loss or damage of any kind (however it may arise or be caused) relating in any way to this website including, but not limited to, loss or damage you may suffer as a result of:

a)      inaccuracies or errors of any kind on this website;

b)      the quality or suitability for any purpose of any Item/Product or of any linked websites.

c)      you acting, or failing to act, on any information whatsoever contained on or referred to on this website and/or any linked website;

d)      any harmful code whatsoever including viruses, bugs, trojan horses or other communications which may be transmitted to or through this website by any third party;

e)      viruses of any kind contained within any file, software, video or audio streaming accessed through this website;

f)       any errors or breach of security of any kind on or arising from the use of this website;

g)      any interruption including maintenance or termination of transmission to or from this website;

h)      any closure of this site either in part or full whether scheduled or otherwise;

i)       any unauthorised use or access to this websites servers;

j)       personal injury or property damage of any kind resulting from your access to or use of this website in any manner whatsoever;

13.2.   Woodbridge Furniture will not be liable for any direct, indirect, special, incidental or significant damages arising out of your access to or use of this website, except as expressly provided in these terms and conditions and to the extent allowed by the law.

13.3.   You will at all times expressly indemnify, and keep indemnified Woodbridge Furniture, including their directors and employees (past or present) from and against any loss (including reasonable legal costs and expenses on a full indemnity basis) or liability incurred or suffered by you or by any of them arising from any claim, demand, suit, action or proceeding by any person against you or them where such loss or liability arose out of or in connection with or in respect of your conduct or breach of these terms and conditions whatsoever.
